The current business world, complex and volatile as it is, brings along its stream of conflicts of interest.
Quite often originating from misunderstandings or diverging interpretations, disputes evolve towards
court settlements which may take very long and always name a winner and a loser while focusing on rights
and duties.
In many cases, the intervention of a competent mediator (sometimes even recommanded
by the lawyers themselves) allow to resolve the problems. One focuses on interest and needs of the parties
and the mediator tries, while letting them express their concerns, to allow the elaboration of a solution
which fits both parties, in a quick, economical and efficient way.
Mediation, as such, is an organized
and confidential negociation where the parties, together with the mediator, negociate directly with
one another. It is a positive approach, privileging active listening and dialogue as opposed to confrontation.
